Terms and Conditions

These Terms and Conditions govern your access to and use of TxtCow, including the website, dashboard, APIs, integrations, and Android app.
Eligibility and Age Requirements
- You must be at least 13 years old to use TxtCow. Users under 13 are not permitted to use this service.
- You must provide accurate account information and keep your credentials secure.
- You are responsible for all activity that occurs under your account, API keys, and registered devices.
- You must be authorized to use any phone number, SIM, device, account, or integration connected to TxtCow.
User Responsibility and Disclaimer
CRITICAL DISCLAIMER: Your use of TxtCow is entirely at your own discretion and risk. TxtCow is provided solely as a technical tool with no responsibility for how you use it. All consequences—legal, financial, regulatory, reputational, or otherwise—arising from your use, misuse, or violation of laws are your sole responsibility. TxtCow and its developers bear absolutely no responsibility for:
- Any unlawful, deceptive, fraudulent, harassing, or abusive messaging you send
- Spam, phishing, malware distribution, or impersonation
- Violation of carrier rules, platform policies, or third-party terms
- Violations of anti-spam, telecom, privacy, consumer protection, or export laws
- Any claims, lawsuits, fines, penalties, or damages resulting from your actions
Service Use
- TxtCow is an SMS gateway service that helps you send and receive SMS through your own Android device and mobile plan.
- You are solely responsible for all message content, recipient selection, consent collection, and legal compliance. You must independently verify that your use complies with all applicable laws before using TxtCow.
- You must comply with applicable anti-spam, telecom, privacy, consumer protection, and export laws in your jurisdiction. Different countries and regions have different regulations, and you are solely responsible for understanding and complying with all local laws in your jurisdiction.
- For users outside South Korea: If you use TxtCow from a country or region other than South Korea, you must comply with that jurisdiction's local telecom, SMS transmission, anti-spam, and consumer protection laws. TxtCow is not responsible for failures, blocks, service restrictions, or legal issues resulting from non-compliance with local regulations in your jurisdiction.
- You must not use TxtCow for unlawful, deceptive, abusive, harassing, fraudulent, or high-risk messaging.
Korean SMS Transmission Limits (KCC Regulations)
If you use a Korean SIM card, the following restrictions from the Korean Communications Commission (KCC) and carriers apply to prevent spam and plan abuse. TxtCow automatically enforces these limits, and transmissions may be blocked if you exceed them.
- 1. Daily Transmission Limits
- Maximum daily transmission: Up to 500 SMS per day. Exceeding this will block SMS transmission for that day.
- Carrier-specific overage limits: If you exceed 200 SMS per day (SKT/LGU+) or 150 SMS per day (KT) more than 10 times in a month, your service may be restricted.
- 2. Single Batch Transmission Limits (Bulk SMS)
- SKT: Maximum 100 recipients
- KT: Maximum 100 recipients (25 recipients on Android 10 OS and below)
- LG U+: Maximum 30 recipients
- Warning: Attempting to send to more recipients than the limit may result in errors.
- 3. Message Character Limits
- SMS (standard): Korean 70 characters / English 160 characters maximum
- Exceeding this may prevent message transmission.
You are responsible for understanding and complying with these limits. TxtCow is not liable for failed transmissions, service restrictions, or transmission failures resulting from these limits.
Restricted Conduct
- No spam, phishing, malware delivery, impersonation, or misleading sender identity.
- No use that violates carrier rules, platform rules, or third-party integration terms.
- No interference with service security, quotas, rate limits, or access controls.
- No reverse engineering, attempting to access unauthorized data, or circumventing security measures.
API Terms and Rate Limiting
- Your API usage is subject to rate limits enforced by TxtCow. Rate limits are implemented to prevent abuse, maintain service quality, and protect infrastructure.
- API rate limits are: 1 request per second per API key, with a daily limit of 5,000 requests. These limits may be adjusted at any time without notice.
- Exceeding rate limits will result in HTTP 429 (Too Many Requests) responses. Repeated violations may result in API key suspension or account termination.
- You are solely responsible for monitoring your API usage and ensuring your integrations comply with these limits. Any consequences of exceeding limits—such as failed message delivery, service interruption, or data loss—are your responsibility alone.
- TxtCow makes no guarantee that your API calls will succeed, complete, or be processed in any specific order.
Third-Party Integrations
- TxtCow may integrate with third-party services (such as webhooks, CRM systems, or external APIs). Your use of these integrations is subject to each third party's terms of service.
- You are solely responsible for understanding and complying with all third-party terms, privacy policies, and legal obligations before connecting any third-party service to TxtCow.
- TxtCow is not responsible for the availability, functionality, security, or legality of any third-party service. You assume all risk when using third-party integrations.
- If a third-party service experiences outages, security breaches, or discontinues operations, TxtCow bears no responsibility for any resulting loss, damage, or interrupted service.
Data Residency
- TxtCow infrastructure is hosted on Oracle Cloud Infrastructure (OCI) in Chuncheon, South Korea. Your account data, message records, API keys, and logs are stored in this region.
- Backups may be maintained in other regions for redundancy and disaster recovery purposes.
- If you have data residency requirements (such as GDPR, CCPA, or local data localization laws), you are responsible for ensuring that using TxtCow complies with those requirements.
Pricing and Billing
- TxtCow's core service is free for personal use. You may send unlimited SMS using your own device and mobile plan.
- Mobile carriers may charge separately for SMS traffic generated through TxtCow. You are solely responsible for all carrier fees and charges.
- Future paid plans (if introduced) will be clearly announced in advance. No charges will be applied to existing free accounts without explicit consent.
- You are responsible for all taxes, fees, and charges associated with your use of TxtCow.
Intellectual Property
- TxtCow software, website, documentation, and code are the intellectual property of TxtCow and its developers. All rights are reserved.
- You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying concepts of TxtCow.
- Any content, messages, or data you upload or transmit through TxtCow remains your property. You grant TxtCow the right to store, process, and display this content solely for the purpose of providing the service.
- TxtCow does not claim ownership of your messages, contacts, or integrations. You retain all intellectual property rights to your content.
Data Retention
- Account information (email, password, API keys) is retained as long as your account is active.
- Message records (sender, recipient, timestamp, delivery status) are retained for 90 days by default. You can request deletion at any time.
- Inbound SMS records are retained for 30 days unless explicitly archived.
- Diagnostic logs and security data are retained for 7 days for troubleshooting and abuse prevention.
- After account deletion, some records may remain in backups for up to 30 days before being permanently deleted.
- You may request earlier deletion of your data by contacting support@txtcow.com.
Availability and Changes
TxtCow may update, suspend, restrict, or discontinue features at any time. We do not guarantee uninterrupted availability, successful carrier delivery, or compatibility with all devices, Android versions, integrations, or networks. You accept the risk that the service may become unavailable at any moment.
Data and Privacy
Our handling of personal information is described in the Privacy Policy, which forms part of these Terms.
Data Subject Rights (GDPR and CCPA)
- GDPR (EU/EEA users): You have the right to access, correct, delete, export, or restrict processing of your personal data. You also have the right to object to processing and lodge complaints with your local data protection authority. Requests can be made to support@txtcow.com.
- CCPA (California users): You have the right to know what personal information is collected, delete information, opt-out of sale (note: TxtCow does not sell data), and not be discriminated against for exercising these rights. Requests can be made to support@txtcow.com.
- Other jurisdictions: Similar data subject rights may apply depending on your location and local privacy laws. Contact support@txtcow.com for more information.
Suspension and Termination
We may suspend or terminate access if we reasonably believe your use creates legal, security, abuse, payment, operational, or reputational risk, or if you breach these Terms. All consequences of suspension or termination are your responsibility.
Disclaimers
TxtCow is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim implied warranties including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted service. TxtCow makes no guarantee that messages will be delivered, received, or processed.
Limitation of Liability
To the maximum extent permitted by law, TxtCow and its developers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, customers, or business opportunities arising from or related to your use of the service. Our total liability is limited to the amount you paid TxtCow in the past 12 months (if any).
Indemnity
You agree to indemnify and hold harmless TxtCow and its developers from any and all claims, liabilities, losses, damages, costs, and expenses (including legal fees) arising from: (1) your content and messages; (2) your recipients and how you contacted them; (3) your integrations and use of third-party services; (4) your failure to comply with laws and regulations; (5) your misuse of the service; or (6) any violation of these Terms by you.
Dispute Resolution and Governing Law
- For users in South Korea: These Terms are governed by the laws of South Korea, without regard to conflicts of law principles. Any dispute arising from these Terms or your use of TxtCow shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the competent courts of South Korea.
- For users in other jurisdictions: These Terms are governed by the laws of Singapore, without regard to conflicts of law principles. Any dispute shall be resolved through binding arbitration under the rules of the Singapore International Arbitration Centre (SIAC), with one arbitrator appointed. The arbitration shall take place in Singapore and shall be conducted in English.
- You waive any right to jury trial or class action lawsuit against TxtCow, except where prohibited by local law.
- Each party shall bear its own legal costs unless the arbitrator or court determines otherwise.
